Drink or Drug Driving

There are two types of drink driving offences with which you can be charged.

  • The first is for driving while under the influence of alcohol, and
  • The second is for driving with the prescribed concentration of alcohol present.

You should obtain legal advice as soon as possible to determine:

  • whether you have a defence available to you,
  • what the cost would be to defend a charge of drink driving, and
  • if found guilty what the minimum period of disqualification is.

If you do wish to explore a defence, you will probably need an expert to give evidence, which we can arrange.

It is particularly important to obtain legal advice if you have prior convictions for drink driving or prior convictions for drive while suspended or disqualified.

It is expected the penalty provisions for drink driving will be amended with even harsher consequences.

A second offence of driving while suspended or disqualified will attract a minimum sentence of one month imprisonment with a maximum of 2 years imprisonment.

It is critical in those circumstances that you be represented.
